General terms and sales sonditions

 

These general conditions apply to the sale of products by Bioco bvba (among other things, through its online store).

Placing an order with Bioco bvba leads to the acceptance of these general conditions.

Bioco bvba reserves the right to change terms and conditions at any time and/or supplement for future orders. Current contracts are subject to the terms and conditions that were applicable at the time of the conclusion of the agreement.

In these terms and conditions, the following definitions shall apply:

“Bioco Webshop”: the website of Bioco on which the products are offered and sold to the customers.

“Customer” means any natural or legal person who places an order.

“Order”: the application by the customer concerning the conclusion of a sales agreement between Bioco bvba and the customer with regard to the products offered by Bioco bvba.

“Products” means all goods offered by Bioco bvba that may form the subject of one or more agreements.

Offers are valid while supplies last.

An agreement will be concluded at the time that an email will be sent to the e-mail address specified by the customer to confirm his order.

The customer and Bioco explicitly agree that a valid agreement can work out by using electronic forms of communication. In particular, the lack of an ordinary signature isn’t detremental to the binding force of the agreement. As far as the law permits, the electronic files of Bioco shall apply as a presumption of proof.

Bioco reserves the right to refuse orders in the following cases:

  • when being out of stock of a product,
  • in severely presumption of abuse or bad faith on the part of the customer,
  • in the event of force majeure.

All prices are expressed in euros and include VAT. The price indicated in the “order confirmation” email is the price payable by the customer. Special offers are only valid while supplies last. Bioco reserves the right to change the price of a product at any time but the products are getting invoiced on the basis of the current rates at the time of the conclusion of the agreement.

Online payments are done via Mollie. You can pay online via Bank Transfer, with a Visa or Master card, Bancontact/Mister Cash, KBC/CBC Button or the Belfius Direct Net Button. (Sofort and Ideal are also used for customers from out of Belgium). An order is treated as soon as we get agreement of the “secured bank payment”-company.

Bioco will never be seen as an involved party between the customer and the card issuer.

When paying by bank transfer, the account number and the payment amount will be communicated in the order confimation e-mail. The order will be sent as soon as the amount is credited to the Bioco account. For payments by bank transfer from outside Belgium, it is mandatory to use the IBAN and BIC code at the payment.

In the event of late payment by the customer or payment related problems of earlier orders, Bioco has the right to cancel an agreement.

Bioco strives to send orders that are placed as soon as possible (within 10 working days).

The proposed delivery time has to be treated as an indication and therefore no rights can be derived from it.

If a product is not in stock, the customer will be informed by e-mail about a later delivery date. If the customer does not agree with this delay, the product ordered may be cancelled or  the customer can order an alternative product. The product will be refunded or cancelled, if you order an alternative product, the difference will be refunded if the alternative products costs less and additional invoiced if it costs more.

If, in case of problems with the delivery, the delivery date is exceeded by 20 working days, the customer is obliged to inform us of this fact by email. In this case, the customer can cancel his order and will get,  within 10 working days after receiving the information from non-delivery, the amount paid back to the same account that the customer used at the moment he paid the order.

Deliveries take place on the address indicated by the customer when ordering. Bioco can, in no way, be held responsible for errors that have been committed by the customer when entering the delivery and/or billing address and which may give rise to delays in the delivery or inability to deliver the products ordered.

As soon as the products are delivered to the specified delivery address the product risks are transferred to the customer.

For orders with delivery address in Belgium:

  •  the customer pays between 3.75 and 7.5 € shipping costs depending the means of transportation.
  •  for order amounts exceeding € 45, the shipping is free.

Shipments outside Belgium can only happen after prior agreement with Bioco.

A customer may NOT exchange the delivered products NOR abandon its order after delivery. This measure is necessary due to the food safety principle that we must follow in relation with trading of food products.

For the communication with its customers and the smooth handling of orders Bioco keeps a number of personal informations. (login information)

Bioco will never undertake actions to pass the data of its customers to third parties.
You may at any time consult or modify your personal data yourself via “my account”. You can also delete this information in whole or in part. This can be done by sending an e-mail to info@bioco.be with your request for deletion.

All pictures and images shown on the Bioco webshop are protected under copyright law. This applies to all images, regardless of the way of spreading or the form in which they are delivered. No photo may be reproduced and/or made public by means of print, photocopy, photo by photo, microfilm, digital or any other means without the prior written consent of Bioco. If you are using a photo of this website without prior consent , you are noticed to discontinue the use immediately and a claim can be submitted to you.

If difficulties arise during the performance of a contract, the customer and Bioco examine, prior to taking legal action, the possibility of a friendly settlement. If this does not solve the issue, only the courts of Brussels shall have sole jurisdiction to hear any claims, regardless of the place of delivery or the residence of the customer.

The agreements and all legal reports between the customer and Bioco are subject to Belgian law.
